1. Introduction These Terms and Conditions govern access to and use of the EPB platform, also referred to as the EB-1 Portfolio Builder platform. By registering for, accessing, or using EPB, you agree to these Terms and Conditions and any related policies presented to you, including the applicable privacy policy.

EPB is a portfolio-building, workflow, evidence-organization, and best-practice guidance platform designed to help users prepare and organize material relevant to EB-1 case development. EPB is not a law firm and, unless you separately book and engage an attorney through the appropriate legal channel, EPB does not provide legal advice, does not create an attorney-client relationship, and does not guarantee any immigration outcome.

2. Eligibility and Account Registration You must provide accurate, current, and complete information when creating and maintaining your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Each account is personal to the registered user. Access may not be shared, sublicensed, transferred, resold, or made available to any other person, organization, consultant, advisor, employer, family member, or third party without explicit written authorization from EPB.

3. Personal Use Only and Platform Access Restrictions Your access to EPB is limited, revocable, non-exclusive, and subject to these Terms and Conditions. You may not: - share your login, account access, or paid membership with another person; - allow any third party to use your account or act through your access credentials; - copy, reproduce, republish, scrape, extract, distribute, sell, license, or exploit platform content, workflow structures, templates, guidance, knowledge materials, or internal tools except as explicitly permitted; - reverse engineer, interfere with, overload, disrupt, or attempt unauthorized access to the platform or its supporting systems; - use automated tools, bots, crawlers, or scraping systems to access platform content or functionality without express written permission.

EPB may monitor account usage, session behavior, IP/device patterns, and other technical indicators for misuse, fraud prevention, security enforcement, or platform protection.

4. Suspension, Lockout, Investigation, and Termination If EPB reasonably suspects account sharing, misuse, unauthorized redistribution, scraping, security compromise, false identity use, platform abuse, suspicious access patterns, or breach of these Terms and Conditions, EPB may immediately suspend or restrict access to the account while an investigation is carried out.

During an investigation, EPB may: - temporarily lock the account; - pause access to paid features; - require identity or account verification; - preserve logs, usage records, and supporting evidence for internal review; - terminate access if the breach is confirmed.

No refund or continued access is guaranteed where suspension or termination results from breach, misuse, fraud, or prohibited sharing.

5. Nature of the Service and Non-Legal-Advice Boundary EPB provides platform access, educational materials, evidence-organization support, workflow tools, portfolio-building guidance, and best-practice recommendations. EPB does not, by default, provide legal advice. Information presented inside the platform is not a substitute for legal counsel and should not be treated as a legal opinion, legal representation, or guarantee of eligibility.

No attorney-client relationship is created merely by registering for or using EPB, receiving guidance in EPB, or interacting with automated tools, staff, or platform content.

Where attorney sessions, attorney referrals, or attorney-reviewed services are offered, legal advice exists only if and when a qualified attorney is formally engaged through the appropriate channel and applicable legal terms.

6. No Guarantee of Approval or Outcome EPB does not promise, warrant, or guarantee approval of an EB-1 petition, immigration benefit, visa, green card, or any government filing outcome. Immigration decisions depend on facts, evidence quality, truthfulness, legal standards, adjudicator review, timing, and matters outside EPB’s control.

Any readiness signals, strategy previews, assessments, category suggestions, scoring, or workflow guidance are informational and operational in nature, not outcome guarantees.

7. User Responsibilities and Truthfulness You are solely responsible for the truthfulness, legality, completeness, and accuracy of all information, uploads, statements, translations, explanations, and materials you submit to EPB.

You agree not to upload or submit fabricated, altered, misleading, stolen, manipulated, or unauthorized documents or content. You also agree not to misrepresent authorship, salary, awards, publications, memberships, roles, judging activity, commercial outcomes, or any other claimed credential.

EPB may restrict, flag, reject, or escalate submitted materials that appear incomplete, inaccurate, irregular, or inconsistent with best-practice evidence standards.

8. Confidentiality, Privacy, and Data Handling EPB will treat client account data, uploaded materials, and operational case information as protected platform information and handle it in accordance with applicable privacy commitments and operational security practices.

You agree that internal EPB materials, staff-side summaries, platform outputs, account structures, and paid workflow content are confidential platform materials and may not be redistributed or shared except where EPB explicitly permits such use.

EPB may use secure processors, infrastructure providers, analytics tools, AI tools, and storage vendors as needed to operate the platform, protect the service, and deliver subscribed functionality, subject to applicable privacy commitments and operational controls.

9. Subscriptions, Billing, and Payment Access Certain EPB features are available only after payment and subscription activation. Access to paid features may include the full strategic plan, category workflow execution features, uploads, AI execution support, meeting tools, attorney referral requests, portfolio-completion functions, and other paid capabilities.

Subscription activation occurs only when EPB confirms payment through its accepted billing workflow. EPB may disable, suspend, or restrict paid features if payment fails, is reversed, is disputed, or is found to be fraudulent.

Applicable billing frequency, renewal timing, cancellation terms, payment processing method, and plan details will be presented through the platform or associated billing process.

10. Refunds, Payment Failures, and Charge Disputes Any refund, cancellation, renewal, or charge-dispute handling will be governed by the stated billing terms in effect at the time of purchase, subject to applicable law.

Where payment fails, is declined, is reversed, or becomes overdue, EPB may downgrade, suspend, or restrict access to paid features until the billing issue is resolved.

11. Intellectual Property and Platform Materials EPB, including its platform structure, workflow architecture, knowledge repository content, templates, prompts, reports, explanatory text, branding, visual assets, and supporting systems, is protected by intellectual property and proprietary rights.

Except for your own submitted materials and any limited rights expressly granted to you, you receive no ownership interest in EPB content or systems.

12. Communications By creating an account and using EPB, you consent to receive operational communications related to your account, subscription, case workflow, notices, reminders, support events, and platform access. These communications may be delivered through in-app notifications, email, or other approved contact methods associated with your account.

13. Availability, Security, and Service Changes EPB may update, improve, suspend, restrict, or change platform features, workflows, UI, content, integrations, or service structure over time. While EPB aims to provide stable access, uninterrupted availability is not guaranteed.

EPB may take reasonable security measures, maintenance actions, emergency restrictions, or operational changes necessary to protect users, platform integrity, or service continuity.

14. Limitation of Liability To the fullest extent permitted by applicable law, EPB and its operators, staff, affiliates, contractors, and service providers are not liable for indirect, incidental, consequential, exemplary, or special damages arising out of or related to use of the platform, inability to use the platform, payment failures, user-submitted inaccuracies, external service outages, third-party processor issues, or immigration outcomes.

You remain responsible for your own legal decisions, filing decisions, evidence truthfulness, and professional-advice choices.

15. Indemnity You agree to indemnify and hold harmless EPB, its operators, staff, contractors, and service providers from claims, losses, liabilities, costs, or expenses arising from your breach of these Terms and Conditions, your misuse of the platform, your violation of law, your infringement of rights, or your submission of false, misleading, or unauthorized materials.

16. Changes to These Terms EPB may revise these Terms and Conditions from time to time. Updated versions may be posted in-platform or otherwise provided to users. Continued use of EPB after updated terms take effect constitutes acceptance of the revised Terms, unless applicable law requires another form of consent.

17. Contact and Legal Review Note Questions about these Terms and Conditions, account restrictions, investigations, or platform compliance should be directed through the designated EPB support or administrative contact channel.
